Terms of Service

1. Acceptance
By creating an account or using Fairshift, you agree to these Terms, our Privacy Policy, and any incorporated policies. If you are using Fairshift on behalf of an organization, you represent that you have authority to bind that organization.
2. The service
Fairshift provides AI personas and automation software that converts inbound interactions (widget, phone, WhatsApp, email, kiosk, avatar link) into customer outcomes. Features may evolve without notice, though we will not remove features paid tiers depend on without 30 days of notice.
3. Account
You must provide accurate registration information and keep your login credentials secure. You are responsible for actions taken under your account. Notify us immediately at security@fairshift.co if you suspect unauthorized access.
4. Acceptable use
You will not use Fairshift to:
- Send spam, phishing, or unsolicited bulk messages.
- Impersonate any person or organization.
- Operate in violation of applicable law (CAN-SPAM, TCPA, GDPR, India's DPDP Act, etc.).
- Compromise security, reverse-engineer, or scrape the platform.
- Generate content that is illegal, infringing, sexually explicit involving minors, violent, or fraudulent.
We may suspend or terminate accounts that violate acceptable use, with or without notice, and we will cooperate with legal requests where required.
5. Fees and payment
Paid plans are billed monthly or annually in advance, in USD via Stripe or INR via Razorpay. Taxes are your responsibility unless noted otherwise at checkout. We may change prices with at least 30 days of notice; your current subscription term is unaffected until renewal.
Credits on top-up are non-refundable and do not expire during an active subscription.
6. Data ownership
You own your content. You grant Fairshift a limited license to process your content strictly to operate the service (render it in the dashboard, send it to the AI providers you configured, store it securely). We do not train models on your content.
7. Third-party providers
Fairshift integrates with third-party AI providers (Anthropic, OpenAI, Google, ElevenLabs, Anam), telephony (Twilio, Bolna), messaging (Meta), payments (Stripe, Razorpay), and infrastructure (Supabase, Railway, Vercel). 8. Availability and support
We target 99.5% monthly uptime. Paid plans include email support with a 24-hour business-day response target. Enterprise agreements may include tighter SLAs as separately negotiated.
9. Termination
You may cancel at any time from Settings → Billing. On cancellation your account remains accessible until the end of the paid period; after that, read-only for 14 days, then purged (subject to legal retention requirements).
We may terminate or suspend for material breach, non-payment over 14 days, or acceptable-use violations. Pro-rated refunds are at our discretion except where required by law.
10. Warranty disclaimer
Fairshift is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. AI-generated output may contain errors; you are responsible for reviewing outputs before acting on them.
11. Limitation of liability
To the maximum extent permitted by law, Fairshift's aggregate liability for any claim arising from these Terms will not exceed the fees you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
12. Governing law
These Terms are governed by the laws of India. Any dispute shall be resolved in the courts of Hyderabad, unless the dispute is with a resident of the European Union or United Kingdom, in which case local consumer-protection laws apply.
